PARENT/GUARDIAN CONSENT WAIVER, RELEASE OF LIABILITY, MEDIA RELEASE & EVENT TERMS

Event: Club M.A.D. Launch Party
Venue: Listening Room at Poe Mill Music, Greenville, South Carolina
Eligible attendees: Ages 13–17

By purchasing a ticket and accepting these terms, I acknowledge and agree to the following on behalf of myself and, where legally authorized, the minor identified in my ticket purchase.

1. PARENT/GUARDIAN AUTHORITY AND CONSENT

I represent that I am the minor attendee’s parent or legal guardian, or otherwise legally authorized to provide the consent described in this agreement. I am at least 18 years old and have authority to accept these terms.

I give permission for the identified minor to attend and participate in the Club M.A.D. Launch Party, subject to the event rules, entry requirements and safety policies described below.

I understand that the event is designed for teenagers and may include music, dancing, movement, social interaction, food and beverages, crowds, and activities in a live-event venue.

2. AGE, IDENTIFICATION AND ADMISSION

The event is exclusively for attendees ages 13–17. All attendees must present a valid school ID at entry and comply with all published entry requirements.

Purchasing a ticket does not guarantee admission. Club M.A.D. reserves the right to deny admission or remove an attendee for failure to meet age, identification, screening, conduct or other applicable safety requirements.

3. DRUG- AND ALCOHOL-FREE POLICY AND BREATHALYZER SCREENING

Club M.A.D. is committed to providing a drug- and alcohol-free event.

As a condition of entry, each attendee must participate in breathalyzer screening administered under the event’s screening procedures. Breathalyzer screening is intended to help enforce the event’s alcohol policy; it does not establish that an individual is free from drugs or other intoxicating substances.

An attendee who refuses screening or receives a result that does not meet the event’s entry requirements may be denied admission. Event personnel may take appropriate safety measures when there is a reasonable concern about possible alcohol or substance use.

Alcohol, illegal drugs and unauthorized intoxicating substances are prohibited. Attendees must not bring, use or distribute prohibited substances at the event.

I understand that screening and entry decisions will be handled under the event’s applicable procedures and that denied admission, removal and any ticket refund will be governed by the published ticket policy and applicable law.

4. CODE OF CONDUCT AND REMOVAL

All attendees are expected to help maintain a welcoming, respectful and safe environment.

The following are prohibited:

  • Bullying, harassment, intimidation, discrimination, threats or fighting.

  • Unwanted physical contact or other inappropriate conduct.

  • Possession or use of prohibited substances or items.

  • Damage to the venue or another person’s property.

  • Deliberately interfering with event operations or refusing reasonable safety instructions.

  • Conduct that creates a reasonable concern for the safety or wellbeing of attendees, staff, volunteers or others.

Club M.A.D. may deny entry, remove an attendee or contact a parent or legal guardian when necessary to address a violation or safety concern. Emergency services or other appropriate authorities may be contacted when warranted.

5. ASSUMPTION OF INHERENT RISKS

I understand that participation in a live social event involving music, dancing, movement, crowds, food and beverages, and interaction with other attendees involves foreseeable risks.

These risks may include accidental slips, trips and falls; collisions or accidental physical contact; minor injuries; illness; allergic reactions; loss of or damage to personal property; and the actions or omissions of other attendees.

I acknowledge these risks and consent to the minor’s participation with an understanding of the event’s nature. I understand that Club M.A.D. cannot guarantee that every risk will be eliminated or that every attendee will behave appropriately.

I accept the inherent risks of participation to the extent permitted by applicable law.

6. RELEASE OF LIABILITY

In consideration of the minor being permitted to attend the event, I, on my own behalf and on behalf of my heirs, representatives and assigns, release and agree not to bring claims against Club M.A.D., its organizers, directors, officers, employees, volunteers, event personnel, sponsors and participating representatives, as well as the venue and its owners, operators, employees and representatives (collectively, the “Released Parties”), for claims arising from the minor’s participation in the event, including claims for personal injury, property loss or damage, to the extent such claims may legally be released under applicable law.

This release is intended to cover ordinary negligence only to the extent a release of that liability is legally enforceable and the applicable claim is within the scope of this agreement.

Nothing in this agreement is intended to release or limit liability that cannot legally be waived, including liability to the extent arising from gross negligence, reckless or intentional misconduct, or other conduct that applicable law does not permit a party to release.

I understand that the enforceability and scope of any release involving a minor may be limited by law. This provision does not guarantee that any particular claim is waived or barred.

7. PARENT/GUARDIAN ACKNOWLEDGMENT OF RESPONSIBILITY

I understand that I am responsible for providing accurate information during ticket purchase and for ensuring that the minor understands the event’s rules and entry requirements.

I understand that the minor remains responsible for their own conduct and that any applicable responsibility for damage, misconduct or other loss will be determined under applicable law. Nothing in this section creates liability where none otherwise exists.

8. EMERGENCIES AND PARENT/GUARDIAN CONTACT

I authorize event personnel to contact me or another designated emergency contact if the minor becomes ill, is injured, violates event safety rules or requires assistance.

In an emergency, I authorize event personnel to contact emergency services and request appropriate assistance when reasonably necessary. I understand that event personnel are not acting as healthcare providers and that any medical evaluation or treatment will be provided by appropriately qualified personnel.

This document does not replace a separate medical authorization where one is required.

9. PHOTO, VIDEO, AUDIO AND LIKENESS RELEASE

I grant Club M.A.D. (Making A Difference), its authorized representatives, and individuals working on its behalf permission to photograph, film, record and otherwise capture the minor attendee’s image, likeness, voice, statements and participation during the event.

I authorize Club M.A.D. to use, reproduce, edit, publish, display, distribute and share these photographs, videos and audio recordings for nonprofit-related purposes, including organizational communications, event promotion, social media, websites, fundraising materials, sponsor and community-partner communications, presentations and reports describing Club M.A.D.’s activities and impact.

I understand that these materials may be published online and may be viewed, shared or redistributed by third parties. Club M.A.D. cannot guarantee the removal of material already distributed or shared by others.

I grant this permission without compensation and understand that neither the minor nor I will receive payment, royalties or other compensation for authorized uses of these materials.

To the extent permitted by applicable law, I release the Released Parties from claims arising solely from the authorized use of these materials in accordance with this release. This provision does not authorize unlawful, defamatory or otherwise unauthorized use of the minor’s image, likeness or recordings.

I understand that I may contact Club M.A.D. to request that future uses of identifiable materials be discontinued where reasonably practicable. Such a request cannot guarantee the removal of material already printed, published, distributed or shared by third parties.

I confirm that I am the minor’s parent or legal guardian, or otherwise legally authorized to provide this media consent.

10. PERSONAL PROPERTY AND SECURITY

Attendees are responsible for their personal belongings. Club M.A.D. cannot guarantee the security of personal property and is not responsible for loss, theft or damage except to the extent liability is imposed by applicable law.

Attendees must comply with venue rules, reasonable security procedures and instructions from authorized event personnel.

11. TICKETS, DENIED ENTRY AND REFUNDS

Admission is subject to the event’s published requirements. A ticket does not override age, identification, screening or conduct rules.

If an attendee refuses required screening, fails to meet entry requirements or is removed for a violation, any refund will be determined under the published ticket policy and applicable law. No provision of this agreement is intended to override a refund right that cannot legally be waived.

12. ELECTRONIC ACCEPTANCE AND RECORD OF AGREEMENT

I understand that the full terms of this agreement are made available through the event description before ticket purchase. By affirmatively checking the required agreement box during checkout, I acknowledge that I have had the opportunity to read these terms and agree to them.

I understand that my electronic acceptance and associated transaction record may be retained by Club M.A.D. as documentation of my acknowledgment and consent, subject to applicable law and the organization’s record-retention and privacy practices.

13. SEVERABILITY AND APPLICABLE LAW

If any provision of this agreement is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. Any unenforceable provision will be limited or severed only to the extent necessary.

This agreement will be interpreted under applicable South Carolina law, without overriding any other law that must apply.

14. FINAL ACKNOWLEDGMENT

By accepting these terms, I confirm that:

  • I have read and understood this agreement.

  • I am authorized to provide the consent described above.

  • I consent to the minor’s attendance subject to the event’s requirements.

  • I understand the assumption-of-risk and release-of-liability provisions and their limitations.

  • I authorize the photography, video and audio recording and uses described in Section 9.
